Abstract

Die Beziehung zwischen dem Innenverhältnis von Gesamtschuldnern einerseits und dem Außenverhältnis der Gesamtschuldner zum Gläubiger andererseits, ist nicht immer frei von Widersprüchen, wenn der Gläubiger einem der Gesamtschuldner die Schuld oder einen Teil hiervon vergleichsweise erlässt. Am Beispiel der Entscheidung des OLG Bremen vom 4. April 2002 (ZBB 2002, 395, in diesem Hefi) werden die - häufig auf den ersten Blick nicht erkennbaren - Probleme - aufgezeigt und die Wirkungen des Vergleichs im Einzelnen erörtert. Darüber hinaus macht der Autor Vorschläge für Vergleichsformulierungen, die auftretende Widersprüche von vornherein verhindern.
