Abstract

Der Artikel behandelt die in der Verständigung vom 17. Juli 2001 mit Wettbewerbshüter Monti gefundene Lösung zur Beendigung des jahrzehntelangen Streits um die Beibehaltung von Anstaltslast und Gewährträgerhaftung bei Sparkassen und Landesbanken. Nunmehr ist nach einer Übergangszeit bis zum 18. Juli 2005 die Gewährträgerhaftung abzuschaffen und die Anstaltslast in einer Weise zu modifizieren, die einer faktischen Abschaffung gleichkommt (zur Problematik, inwieweit die im Rahmen der anstehenden Reform des jeweiligen Landesrechts übergangsweise fortgeltende Gewährträgerhaftung im Sinne einer timeliness of payment geregelt werden soll, Füßer, ZBB 2002, 300, in diesem Heft). Der Artikel gibt überdies einen Ausblick auf die hieraus resultierenden Chancen und Risiken für die Sparkassenfinanzgruppe.
