Neue EG-Investmentrichtlinien

Abstract

Selten ist eine kapitalmarktrechtliche EU-Richtlinie sehnlicher erwartet worden, als die nachstehend abgedruckten Richtlinien zur Änderung der auf das Jahr 1985 zurückdatierenden „Richtlinie zur Koordinierung der Rechts- und Verwaltungsvorschriften betreffend bestimmte Organismen für gemeinsame Anlagen in Wertpapieren" (sog. OGAW-Richtlinie). Letztere war der - von Anfang an fragmentarische - Versuch, das Recht der Investmentfonds europaweit zu harmonisieren. 1985 gelang dies nur für Wertpapierfondsprodukte, denen damit ein produktbezogener „Europa-Pass" zuerkannt wurde. Die stürmische Expansion der Investmentbranche (Verdreifachung des Anlagevermögens der Investmentgesellschafien allein in den Jahren 1995-2000) und die fortschreitende Ausdifferenzierung der Fondsprodukte machten einen zweiten Harmonisierungsanlauf unausweichlich. Die über ein Jahrzehnt andauernden Vorbereitungsarbeiten an „OGAW II" sind erst Ende 2001 zum Abschluss gelangt; das Ergebnis sind gleich zwei Anderungsrichtlinien zu „OGAWI".
