II. Rezensionen. Der Widerruf des Haustürgrundpfandkredits

Abstract

Der Aufsatz erläutert das mit Spannung erwartete BGH-Urteil vom 9. April 2002 (ZBB 2002, 174, in diesem Heft) zum Widerruf von Immobiliardarlehensverträgen im Fall Heininger, zu dem der EuGH aufgrund der hierfür eingeholten Vorab-Entscheidung (ZBB 2002, 29 m. Bespr. Kulke, S. 33) wesentliche Vorgaben gemacht hat. Der Verfasser stimmt dem Bundesgerichtshof im Wesentlichen zu, hält aber die Widerrufsfolgen noch nicht für geklärt. Im Anschluss daran werden kritisch die Konsequenzen erläutert, die der Gesetzgeber des nunmehr in aller Eile verabschiedeten „Verbraucherwiderrufs-Korrekturgesetzes" (ZBB 2002, 233, in diesem Heft) aus den Entscheidungen des Bundesgerichtshofs und des Europäischen Gerichtshofs gezogen hat, um die Materie europarechtskonform zu gestalten
