Abstract

Veranlasst durch die bei den Gerichten immer häufiger auftretenden Fälle von in einer Haustürsituation zustande gekommenen Realkreditverträgen hatte der Bundesgerichtshof die Frage vorgelegt, ob ein Realkreditvertrag von der Haustürgeschäfterichtlinie erfasst wird. Der Europäische Gerichthof hat mit Urteil vom 13. Dezember 2001 hinreichend deutlich entschieden und mit seiner Entscheidung auch ein Zeichen gesetzt, das über die Frage der Widerruflichkeit von Realkreditverträgen hinaus Bedeutung für die Bankenhaftung im Rahmen der Immobilienerwerbermodelle haben dürfte. Der Verfasser stellt die Hintergründe dar. Er begrüßt die klare Entscheidung des EuGH und sieht dadurch eine realistische Möglichkeit, dass sich die gebotene konsequente Anwendung des Verbraucherschutzrechts auch in der Rechtsprechung deutscher Gerichte durchsetzt.
