Entwicklungen im Europäischen Bankrecht - Eine Bestandsaufnahme

Abstract

Die Entwicklungen auf dem Gebiet des Europäischen Bankrechts haben bis heute zu einer weitreichenden Harmonisierung der Regelungsmaterie und einer Koordinierung der Aufsichtstätigkeit europäischer Bankaufsichtsbehörden geführt. Der Beitrag zeichnet die Entwicklungslinien dieses Prozesses für den Bereich des Europäischen Bankaufsichtsrechts nach und stellt sie den aktuellen Regelungsvorhaben, wie sie zuletzt durch den Aktionsplan für Finanzdienstleistungen Ausdruck gefunden haben, gegenüber. Die Betrachtung zeigt, dass die Regelungsbemühungen keinesfalls zum Abschluss gekommen sind. Wesentliche Herausforderungen für die Zukunft ergeben sich aus den aktuellen Vorschlägen des Baseler Bankenausschusses zur Überarbeitung des Eigenkapitalrahmens und dem Ziel einer verstärkten Koordinierung der Bankenaufsicht auf Gemeinschaftsebene.
