Kollisionsrechtliche Aspekte des Überweisungsgesetzes

Abstract

Durch das am 14. August 1999 in Kraft getretene Überweisungsgesetz hat der deutsche Gesetzgeber die EG-Uberweisungsrichtlinie umgesetzt und durch die Regelung von Giro-, eigenständigem Überweisungs- und Zahlungsvertrag auch weitreichende dogmatische Eingriffe in das Überweisungsrecht vorgenommen. Das Gesetz enthält zwar in Art. 228 EGBGB eine intertemporale Kollisionsnorm, die hier außer Betracht bleibt, nicht dagegen eine international- privatrechtliche, so daßfür die Anknüpfung des Vertragsstatuts weiterhin die allgemeinen Vorschriften des EGBGB zur Anwendung kommen. Der nachfolgende Beitrag befaßt sich mit der Frage, ob die Eingriffe in das deutsche Sachrecht ein Umdenken bei der kollisionsrechtlichen Behandlung des Überweisungsvorgangs erfordern
