Abstract

Der diesjährige Bankrechtstag war einem Gedanken- und Erfahrungsaustausch über die Fragen des Outsourcing von Funktionen durch Kreditinstitute gewidmet. Einen Schwerpunkt bildete dabei die vorgesehene Regelung durch den Entwurf eines Rundschreibens des Bundesaufsichtsamtes für das Kreditwesen zur „Auslagerung von Bereichen auf ein anderes Unternehmen gemäß § 25a Abs. 2 KWG“. Dieser Entwurf vom 14. Juni 2000, abgedruckt in ZBB-Dokumentation, S. 282 (in diesem Heft) stellt einen wichtigen Markstein in der Rechtsdiskussion dar, die bereits mit einem ersten Rundschreibensentwurf im Jahre 1998 begonnen hatte. Des weiteren beschäftigten sich Vorträge und Diskussionen mit gesellschaftsrechtlichen und datenschutzrechtlichen Aspekten des Outsourcing sowie mit der Rechtslage in Östeneich und der Schweiz.
