Der europäische Paß für Zweigniederlassung Instituten aus deutscher Sicht

Abstract

Seit Erlaß der Zweiten Bankrechtskoordinierungsrichtlinie besteht für europäische Kreditinstitute die Möglichkeit, aufgrund ihrer im Heimatstaat erteilten Bankerlaubnis europaweit Zweigniederlassungen zu errichten. Die Wertpapierdienstleistungsrichtlinie hat das Prinzip der grundsätzlichen Heimatlandaufsicht auf Wertpapierdienstleistungsunternehmen erstreckt. Aus deutscher Sicht geht es um zwei Gestaltungen. Der erste Fall betrifft deutsche Institute, die im europäischen Ausland Zweigniederlassungen errichten. Im zweiten Fall gründen im europäischen Ausland beheimatete Institute Zweigniederlassungen in der Bundesrepublik.
