Europäische Grundfreiheiten - terra incognita?

Abstract

Am Beispiel eines Urteils des LG Düsseldorfwird die Praxis deutscher Gerichte untersucht, die Abwendung der Zwangsvollstreckung gegen Sicherheitsleistung durch eine Bankbürgschaft gerade einer deutschen oder im Inland ansässigen Bank oder Sparkasse zuzulassen. Dabei dräng} sich die Frage auf, ob der Ausschluß von Bankbürgschaften EG-ausländischer Banken und Sparkassen als prozessuale Sicherheiten etwa durch die Autonomie der Mitgliedstaaten hinsichtlich ihres Verfahrensrechts gerechtfertigt ist oder aber gegen den europarechtlichen Grundsatz der Dienstleistungsfreiheit verstößt
