Abstract

Durch die Sechste KWG-Novelle wurde §1 um neue aufsichtspflichtige Geschäftsarten ergänzt. Welcher Art von Bankgeschäft oder Finanzdienstleistung diese Geschäftstätigkeiten zuzuordnen sind, ist dabei noch nicht eindeutig geklärt. Besondere Probleme ergeben sich für die Geschäftsarten, die sich mit dem Handel mit Finanzinstrumenten befassen. Diese Zuordnungsfrage muß jedoch beantwortet werden, um die erlaubnisfreien von den erlaubnispflichtigen Geschäftsarten zu unterscheiden. Der Beitrag untersucht das Finanzkommissionsgeschäft, den Eigenhandel, die Anlage- und Abschlußvermittlung sowie den Handel mit Finanzinstrumenten für eigene Rechnung auf das Erfordernis einer Erlaubnis hin und entwickelt Abgrenzungskriterien, die eine Einordnung als erlaubnisfreies oder erlaubnispflichtiges Geschäft ermöglichen
