Die Lebensversicherungshypothek als „wirtschaftliche Einheit“

Abstract

Lebensversicherungshypotheken sind Allfinanzprodukte, die als Alternative zum Annuitätendarlehen angeboten den Tilgungsbeitrag des Kreditnehmers in eine kapitalbildende Lebensversicherung mit Risikoschutz umleiten. Der dabei angegebene Effektivzinssatz des Kredites berücksichtigt nicht die durch die Koppelung entstehenden Zusatzkosten und ist daher für einen Vergleich mit anderen Darlehen ungeeignet. Außerdem entstehen erhebliche Nachteile bei vorzeitiger Beendigung sowie Risiken aus der Unsicherheit der Lebensversicherungsrendite. Der Beitrag faßt die bisherige Kritik und Rechtsprechung auf dem Hintergrund der EU-Rechtsetzung zusammen und entwickelt auf der Basis der Rechtsfigur der „wirtschaftlichen Einheit“ ein Kreditrechtsmodell, das dem Verbraucher unter Wahrung der berechtigten Belange der Kreditgeber auch bei dieser Form den allgemein für Hypothekenkredite an Verbraucher geltenden Schutz garantiert.
