Das neue Recht der Banküberweisung

Abstract

Das neue Uberweisungsrecht ist vor kurzem in seiner ersten Stufe, nämlich für grenzüberschreitende Uberweisungen in EU- und EWR-Staaten in Kraft getreten. Für inländische Uberweisungen und Überweisungen in Drittstaaten wird es ab dem 1. Januar 2002 gelten. Die bisherige Konstruktion des Überweisungsaufirages als Weisung des Girokunden i.S.d. §665 BGB wurde aufgegeben. Die Neuregelung ist in der Weise angelegt, daß die Überweisungskette in ihre verschiedenen rechtlich relevanten Teilabschnitte zergliedert wird und diese Segmente eigenen, zum Teil sehr differenziert ausgestalteten Vertragstypen zugeordnet werden. Das neue Recht ist dadurch recht kompliziert geraten. Die folgende Darstellung gibt einen Überblick über die neuen Vorschriften und vertieft einzelne ausgewählte Problemkreise
