II. Rezension. Kreditsicherheiten und Verbraucherschutz auf dem Prüfstand des Europarechts

Abstract

Nicht nur in der Literatur, sondern auch in der Rechtsprechung ist die Anwendbarkeit des Verbraucherschutzrechts auf Kreditsicherheiten umstritten. So bestehen beispielsweise zwischen dem IX. und dem XI. Zivilsenat des Bundesgerichtshofs unterschiedliche Auffassungen darüber, ob das Haustürwiderrufsgesetz auch dem Bürgen zugute kommen kann. Nach einer Vorlage des LG Potsdam wird sich zum wiederholten Mal auch der Europäische Gerichtshof mit dieser Problematik beschäftigen. Seine Auslegungsvorgaben, ihre Berücksichtigung im Rahmen der Dietzinger- und der Baukran-Entscheidung des Bundesgerichtshofs sowie der Einfluß des europäischen Richtlinienrechts auf die Dogmatik des nationalen Rechts werden von der Verfasserin kritisch erörtert
