Das neue Werberecht der Wertpapierfirmen: §36b WpHG

Abstract

In einer viel beachteten Entscheidung hatte der Europäische Gerichtshof im Jahre 1995 über die Rechtmäßigkeit von grenzüberschreitender unerwünschter Telefonwerbung für Finanzdienstleistungen zu entscheiden; jüngst hat der Bundesgerichtshof eine Klausel zur Telefonwerbung beanstandet. Der zum 1. Januar 1998 neu eingeführte §36b WpHG schafi eine spezialgesetzliche Grundlage, um dem Bundesaufsichtsamt für den Wertpapierhandel die Möglichkeit zu geben, gegen Mißstände bei der Werbung von Wertpapierfirmen einzuschreiten. Wegen zahlreicher Verbraucherbeschwerden möchte das Aufsichtsamt alsbald eine erste Allgemeinverfügung erlassen. Der Verfasser zeigt den europarechtlichen Hintergrund der Vorschrift auf und entwickelt Fallgruppen rechtswidriger Werbung von Wertpapierfirmen zum § 36b WpHG.
