Abstract

Der Bundesgerichtshof setzt mit seinem Urteil vom 8. Oktober 1998 neue Akzente in seiner Rechtsprechung zur Bürgschaft naher Angehöriger und bringt die Entwicklung dieser Rechtsprechung seit der Bürgschaftsentscheidung des Bundesverfassungsgerichts vom 19. Oktober 1993jetzt zu einem gewissen Abschluß. Das gibt dem Verfasser Anlaß zu einem Resümee. Er unterscheidet Verfassungsrechtssatz und Zivilrechtssatz und unterzieht auf der Grundlage dieser Unterscheidung das Verständnis der zivilrechtlichen Prinzipien der Privatautonomie und der Inhaltskontrolle von Verträgen durch das Bundesverfassungsgericht einer durchgreifenden Kritik. Eine positive Würdigung findet die seitherige Rechtsprechung des Bundesgerichtshofs. In der Tradition des klassischen Zivilrechts stehendgelingt es ihr, dem entscheidenden Falltyp immer klarere Konturen zu geben.
