Abstract

In Österreich ist am 1. Januar 1998 eine tiefgreifende Novellierung des Börserechts in Kraft getreten. Die Neugestaltung setzte vor allem die „Privatisierung" der Wiener Börse um, indem sie ein (dem Bankrecht angelehntes) Konzessionssystem für privatrechtlich organisierte Börsen schuf, das Mitgliedsrecht aktualisierte und privatisierte sowie zahlreiche hoheitliche (u. a. Straf-)Konsequenzen auf die Bundes-Wertpapieraufsicht (BWA) übertrug. Hoheitliche Aufgaben im Bereich des Zulassungsrechts verblieben jedoch beim Börseunternehmen. Der vorliegende Beitrag bietet einen umfassenden Einblick in die neuen Rechtsregeln, beleuchtet einige Widersprüchlichkeiten und Schwachstelkn und möchte Richtungen möglicher Weiterentwicklung aufzeigen.
