Einlagensicherung und Anlegerentschädigung nach europäischem und deutschem Recht

Abstract

Zum 1. August 1998 ist das Einlagensicherungs- und Anlegerentschädigungsgesetz in Kraft getreten. Es dient der Umsetzung der EG-Einlagensicherungsrichtlinie und der EG-Anlegerentschädigungsrichtlinie in deutsches Recht. Die Richtlinien verbessern den Schutz der Anleger im Fall der Insolvenz eines Kreditinstituts oder einer Wertpapierfirma. Die EG-Kommission ordnet die Richtlinien daher als ebenso wichtig für die Vollendung des Binnenmarktes ein wie die Harmonisierung des Aufsichtsrechts. Der Beitrag zeigt die Entstehung den Inhalt und die Lücken der Richtlinien auf und setzt sich kritisch mit der Umsetzung in das deutsche Recht auseinander.
