Abstract

Das nicht rechtskräftige Urteil des OLG Frankfurt/M. vom 24. November 1997 (ZBB 1998, 237) gibt Anlaß für die Erörterung verschiedener bankrechtlicher Probleme. Dabei stehen die Unterschiede zwischen der Garantie „auf erstes Anfordern" sowie der Bürgschaft „auf erstes Anfordern " im Vordergrund, die sich unmittelbar auf die Rückabwicklung nach materiell ungerechtfertigter Inanspruchnahme des Sicherungsgebers und die Verteilung des Insolvenzrisikos auswirken. Auf der Basis eines neuen gedanklichen Ansatzes untermauert der Verfasser die Ergebnisse der vorherrschenden Auffassung und kritisiert die Urteilsgründe. Hiervon ausgehend entwickelt er ein Modell für die höchst umstrittene bereicherungsrechtliche Rückabwicklung in Zessionsfällen bei Mängeln der zedierten Forderung
