II. Rezension. Zur Haftung des gutgläubigen Zahlungsempfängers bei gefälschtem Überweisungsauftrag

Abstract

Mit dem Beschluß des OLG Köln liegt erneut eine Entscheidung vor, die sich mit der Rückabwicklung von Vermögensverschiebungen aufgrund eines gefälschten Überweisungsauftrages befaßt. Nach Ansicht des Verfassers trägt die Entscheidung nicht hinreichend den schutzwürdigen Belangen des Zahlungsempfängers Rechnung. Das Oberlandesgericht verkenne, daß in den Fällen, in denen neben dem Kontoinhaber und dem gutgläubigen Zahlungsempfänger eine weitere Person (seil, der Fälscher) an der Vermögensverschiebung beteiligt ist, dieser in die Rückabwicklungsüberkgungen einzubeziehen sei.
