Xây dựng nhà nước pháp quyền trong tư duy của Đảng Cộng Sản Việt Nam

Abstract

Kế thừa những quan điểm cơ bản của Hồ Chí Minh về xây dựng nhà nước của dân, do dân, vì dân với hiệu lực pháp lý mạnh mẽ, Đảng Cộng sản Việt Nam với những nỗ lực của mình, trong điều kiện hoàn cảnh mới đã bổ sung những hiểu biết và nhận thức mới về nhà nước pháp quyền. Năm 1994, sau 8 năm đổi mới, thuật ngữ “nhà nước pháp quyền” đã được chính thức đưa vào vào văn kiện Hội nghị giữa nhiệm kỳ khóa VII của Đảng. Nhà nước pháp quyền xã hội chủ nghĩa ở Việt Nam tiếp tục được định hình và khẳng định ngày càng rõ ràng hơn trong Cương lĩnh xây dựng đất nước trong thời kỳ quá độ lên chủ nghĩa xã hội năm 1991 sửa đổi năm 2011 và đặc biệt là Hiến pháp năm 1992 sửa đổi năm 2013 đã thể hiện rõ ràng quan điểm về xây dựng nhà nước pháp quyền của Đảng Cộng sản Việt Nam.
