Dinsel/Islami Hukuk Kavramı ya da Felsefe-Din ve Hukuk Iliskisi Uzerine Bir Yaklasım

Abstract

Toplumun hukuku ‘mesru’ addetmesi toplumsal barıs ve esenlik icin buyuk onem arz eder kuskusuz. Peki, bu nasıl saglanabilir? Baska bir anlatımla “İnsanlıgın hukuku/beseri hukuk” ile “dinsel/İslami hukuk”, ozu itibariyle, cakısan/cakısabilen kavram ve olgular olarak degerlendirilebilir mi? Toplumsal yasam acısından, adil ve esenlikli bir dünyanın kurulabilmesi acısından, yasamın insanilestirilmesi acısından, toplumsal ahlak ve hukuk acısından önemli olan ve aynı zamanda dinin/İslamiyet’in temel degerlerinden birisini olusturan “adalet” kavramı teorik ve olgusal olarak hayatımızda yeterince ve bihakkın islevsellesebilmis midir? Çalışmanın amacı, belirtilen baglamda katkı sunmaya calışmak, ufuk acmayı denemekten baska bir sey degildir.
