Gender Pay Gap Legislation, Evaluating the Effectiveness of Legal Interventions in Morocco

Abstract

Purpose: The aim of the study was to assess the gender pay gap legislation, evaluating the effectiveness of legal interventions in Morocco. Methodology: This study adopted a desk methodology. A desk study research design is commonly known as secondary data collection. This is basically collecting data from existing resources preferably because of its low cost advantage as compared to a field research. Our current study looked into already published studies and reports as the data was easily accessed through online journals and libraries. Findings: Gender pay gap legislation has been implemented in various countries with the aim of addressing disparities in wages between men and women. The study suggest that legislation has led to a reduction in the gender pay gap, others indicate that progress has been slow or stagnant. Factors such as enforcement mechanisms, cultural attitudes, and the presence of other forms of discrimination within the workforce can influence the impact of these laws. Additionally, the effectiveness of gender pay gap legislation may vary depending on the specific context and implementation strategies within each country. Implications to Theory, Practice and Policy: Human capital theory, institutional theory and gender role theory may be used to anchor future studies on assessing the gender pay gap legislation, evaluating the effectiveness of legal interventions in Morocco. Organizations should invest in training programs that raise awareness about unconscious biases, discrimination, and systemic barriers contributing to the gender pay gap. Policymakers should enhance the enforcement of gender pay gap legislation by imposing stricter penalties for non-compliance and conducting regular audits to ensure organizational adherence to reporting requirements.
