La evolución de los servicios de pago y su reflejo en la regulación europea

Abstract

En este artículo se aborda la definición de los servicios de pago que recoge la normativa de la Unión Europea (UE) sobre la materia (PSD2) y se exponen a continuación las diversas cuestiones interpretativas que han suscitado esas definiciones a lo largo de los últimos años. Seguidamente, se describen brevemente las novedades que, en relación con la identificación de los servicios de pago, introducen las propuestas de la Comisión Europea de 2023 para una nueva directiva (PSD3) y un nuevo reglamento (PSR) de servicios de pago. Finalmente, se incluyen unas breves consideraciones relativas al dinero electrónico y a los servicios de dinero electrónico incorporados en la PSD3 y el PSR.
