La responsabilidad civil por la deforestación como daño ambiental puro en el Perú

Abstract

La deforestación en el Perú ha alcanzado niveles alarmantes, causando pérdida de la biodiversidad y desequilibrando el ecosistema. Este daño es distinto a los demás, puesto que no perjudica a una persona individual, sino a una colectividad indeterminada, la doctrina le denomina “daño ecológico puro”. Diferentes ramas del derecho han tratado de resolver este problema sin éxito. No obstante, creemos encontrar la solución en un mecanismo especial, nos referimos a la responsabilidad civil-medioambiental. En la presente investigación se plantea que, quien deforeste responda civilmente, reparando in natura o a través de una indemnización, la que se invertirá en proyectos de reforestación y forestación, contribuyendo de esta manera a la conservación de nuestros bosques. Este estudio se desarrolló como resultado del XI Concurso Anual de Investigación CIES 2009, con el auspicio de la Agencia Canadiense para el Desarrollo Internacional (ACDI), el Centro Internacional de Investigaciones para el Desarrollo (IDRC, por sus siglas en inglés) y el Banco Scotiabank.
