Take notice! The legal and commercial impact of the General Data Protection Regulation’s rules on privacy notices

Abstract

Privacy notices have a key role to play in data protection compliance: they form one of the means by which data controllers can comply with their obligations to obtain the informed consent of the data subject and they are also one of the means by which data controllers can comply with the new transparency requirements under the General Data Protection Regulation (GDPR) 2016/679. This paper examines the impact that the GDPR will have on the content and communication of existing Privacy Notices by contrasting the new privacy notice requirements under the GDPR, with the current requirements under the Data Protection Act 1998.
