The State Capacity in the Management of Mining Environmental Liabilities in Peru

Abstract

Since 2004, Mining Environmental Liabilities in Peru have had a specific legal and institutional framework, the purpose of which is to facilitate their remediation, promote their reuse or reuse. However, of a universe of 7,956 Mining Environmental Liabilities registered as of 2021, only 39% have an environmental management instrument that allows actions to be taken to resolve their presence in the territory. The evidence gathered in this research suggests that installed state capacity for the management of Mining Environmental Liabilities is insufficient and encounters obstacles in its implementation that are due to factors linked to the conditions under which the interventions are carried out. They highlight the limitations of the process of identification, characterization and prioritization of these liabilities, the social resistance and inter-institutional conflicts and the complexity of the relations between the State and international cooperation agencies.
