Dimensiunea constituțională a libertății de conștiință în statele democratice

Abstract

Studiul își propune să evidențieze limitele exercitării libertății de conștiință. În realizarea cercetării au fost utilizate mai multe metode științifice, precum metoda comparativă, analitico-sintetică, precum și cea logică. Metoda logică este una relevantă cercetării problematicii elucidate, deoarece structurează conceptele libertății de conștiință într-o manieră logică, excluzând conflictele de reglementări. Metoda comparativă a permis evidențierea diferențelor și asemănărilor dintre diverse sisteme constituționale democratice. În concluzii am constatat că libertatea de conștiință reprezintă un pilon esențial al democrației și al statului de drept. Rezultatele evidențiază faptul că acest drept este garantat la nivel constituțional în majoritatea statelor democratice, dar modalitățile de aplicare diferă în funcție de contextul juridic și cultural. De asemenea, s-a observat că există o tendință de consolidare a protecției acestui drept prin jurisprudența Curții Europene a Drepturilor Omului. Totodată, cercetarea relevă necesitatea menținerii unui echilibru între libertatea de conștiință și alte valori sociale protejate de stat.
