Modalitățile de evaluare a pagubelor în cazurile de contrafacere a mărcilor

Abstract

Modalitatea de evaluare a despăgubirilor în materia contrafacerii a fost dintotdeauna o problemă complexă pentru specialiștii care se preocupă de combaterea fenomenului contrafacerii, precum și pentru instanțele de judecată care urmează să dea apreciere probelor care confirmă întinderea despăgubirilor solicitate de titularul de drepturi. În același context, aceasta reprezintă o provocare și pentru un avocat care urmează să demonstreze în instanța de judecată care este întinderea despăgubirilor pe care urmează să le dicteze instanța de judecată pentru actul de contrafacere. Or, în prezentul articol am încercat să explicăm modalitatea de evaluare a despăgubirilor materiale, acceptate de instanța de judecată în cauza civilă nr. 2c-757/2020 în speranța că aceasta va deveni o practică juridică pertinentă pentru instanțele de judecată din Republica Moldova.
