Modalități de protejare a masei debitoare

Abstract

În literatura de specialitate, conceptului de formare a masei debitoare nu i se oferă o definiție clară. Conținutul acestui concept, de regulă, este dezvăluit prin analiza algoritmului de acțiuni și măsuri ale instanței de insolvabilitate, administratorului/lichidatorului în vederea formării masei debitoare. Fiind prima etapă de bază a procedurii de faliment, formarea masei debitoare este de mare importanță și prezintă un interes maxim pentru creditori. De fapt, aceasta este pregătirea pentru implementarea ulterioarei proceduri de faliment, de lichidare a debitorului insolvabil sau de constatare a solvabilității debitorului. Măsurile provizorii luate de către instanța de insolvabilitate, administrator/lichidator sunt menite să împiedice debitorul insolvabil, pe parcursul derulării procesului de insolvabilitate, în eventuala lui intenție de a distruge sau înstrăina bunurile și să prevină administrarea ineficientă a activului patrimonial. Importanța acestor măsuri constă în faptul că, prin aplicarea lor, sunt apărate drepturile participanților în cadrul procedurii insolvabilității.
