Confiscarea extinsă versus confiscarea specială

Abstract

Tema „Confiscarea extinsă versus confiscarea specială” explorează două abordări diferite în procesul legal de confiscare a bunurilor în cadrul investigațiilor penale sau al proceselor judiciare legate de infracțiuni. Confiscarea extinsă se referă la confiscarea tuturor bunurilor asociate cu infracțiunea, indiferent de proprietar sau de implicarea directă în infracțiune, în timp ce confiscarea specială se concentrează pe confiscarea bunurilor care sunt direct legate de infracțiune și de persoanele implicate în aceasta. Principalele diferențe dintre cele două tipuri de confiscare se constată în măsura confiscării și în amploarea impactului asupra părților implicate.
