Consideraţii generale privind regimul juridic al programelor de calculator

Abstract

Autorul sau titularul de drepturi asupra unui program de calculator poate beneficia de mai multe instrumente legale de protecţie a acestuia. Programul de calculator de sine stătător este protejabil în baza sistemului de drept de autor, totuși, în anumite cazuri, acesta poate beneficia de protecţia juridică acordată de brevetul de invenţie, precum și de prevederile ce ţin de combaterea încălcărilor secretelor comerciale. E nevoie de o bună înţelegere a particularităţilor de protecţie pentru alegerea celei mai bune și sigure strategii de protecţie, fapt ce va conduce autorul/titularul de drepturi spre cea mai eficientă valorificare a drepturilor sale.
