Instrumente juridice împotriva încălcării drepturilor de proprietate intelectuală în mediul online (II)

Abstract

Încălcarea drepturilor de proprietate intelectuală în mediul online reprezintă, de multe ori, acţiuni extrem de complexe și complicate, mai ales din punct de vedere tehnologic. Prin urmare, reacţia societăţii la încălcările respective urmează a fi rapidă și eficientă. Combaterea fenomenelor de contrafacere și piraterie în mediul online trebuie să presupună, mai întâi, o analiză complexă din partea autorităţilor a factorilor care favorizează aceste fenomene, urmată de implementarea eficientă a acţiunilor concrete. Considerăm că, în mod prioritar, trebuie să fie ajustat cadrul legal din domeniu. Chiar dacă dispune de unele nstrumente juridice de contracarare a încălcărilor drepturilor de proprietate intelectuală în mediul online, Republica Moldova are nevoie de reglementarea unor măsuri juridice noi în acest sens menite să faciliteze asigurarea respectării drepturilor în condiţiile dezvoltării tehnologice actuale.
