Răspunderea penală pentru infracţiunea de omor săvârșit în stare de afect

Abstract

Noutatea şi originalitatea ştiinţifi că a acestui articol constau în evidenţierea tuturor aspectelor ce ţin de starea de afect, începând cu durata de timp de la momentul provocării până la apariţia stării de afect, durata de timp de la momentul apariţiei intenţiei în starea de afect și realizarea ei, comiterea omorului, precum și de durata stării de afect provocată de anumiţi factori, de intenţia de omor săvârșit în stare de afect. Autorul pune problema calificării corecte a infracţiunii prevăzute de art.146 CPRM, fi ind propuse unele modificări la Codul Penal care ar permite aplicarea cât mai corectă și obiectivă a normei date.
