Contrafacerea produselor ca formă a concurenţei neloiale

Abstract

Fenomenul contrafacerii este cunoscut în întreaga lume, doar că efectele și proporţiile acestuia se manifestă peste tot diferit. Pierderile cauzate de contrafacere întreprinzători-lor, titularilor de mărci, dar și statelor, sunt uriașe. Consecinţele nefaste ale contrafacerilor îi afectează nu doar pe titularii de mărci, ci și pe consumatori. Contrafacerea trebuie combătută și pentru că de-naturează concurenţa, pentru că, prin lipsa de onestitate, contrafăcătorul obţine profi turi în dauna celui care a investit în marcă și în bunurile pe care le produce cu însemnate eforturi, trebuie combătu-tă și pentru că încălcarea oricărui drept, nu doar a dreptului la marcă, nu poate fi tolerată.
