Protecţia mărcilor Campionatului mondial de fotbal FIFA împotriva actelor de concurenţă neloială

Abstract

Cercetarea are drept scop preluarea bunelor practici din alte ţări, la caz Federaţia Rusă, pentru posibila aplicare a acestora în activităţile de investigare a cazurilor de concurenţă neloială. În doctrina autohtonă există o lucrare prin care s-a cercetat protecţia drepturilor de autor și drepturilor conexe ale FIFA în cadrul Campionatului Mondial de Fotbal 2018. Distinct, de lucrarea supra, autoarea cercetează protecţia proprietăţii industriale prin prisma protecţiei dreptului asupra mărcii FIFA împotriva actelor de concurenţă neloială săvârșite de diverse întreprinderi pe teritoriul Federaţiei Ruse, în perioada pregătirii și/sau desfășurării Campionatului Mondial de Fotbal 2018. În lucrare au fost identificate formele de concurenţă neloială ce implică utilizarea simbolicii FIFA, probele ce dovedesc comiterea actului de concurenţă neloială, procedura de investigare etc. La fel, se dă apreciere acţiunilor întreprinse de Federaţia Rusă în vederea asigurării protecţiei mărcilor FIFA de săvârșirea concurenţei neloiale.
