Unele consideraţii privind interpretarea noţiunilor de contrafacere, piraterie și plagiat

Abstract

În contextul armonizării legislaţiei naţionale cu standardele internaţionale, deseori apar noi termeni sau noţiuni care, fiind interpretate eronat, generează conflicte și împiedică consolidarea unei practici corecte în soluţionarea acestora. În acest sens, sunt supuse analizei trei noţiuni, mai des utilizate, din domeniul proprietăţii intelectuale: contrafacere, piraterie și plagiat. Autorul nu indică expres asupra unei sau altei căi de soluţionare onestă a conflictelor, ci punctează câteva lucruri importante asupra cărora urmează să medităm atunci când suntem puși în faţa situaţiilor în care trebuie să decidem dacă noţiunea utilizată reflectă corect acţiunea pretinsă a fi sancţionată.
