Unele consideraţii privind evoluţia dreptului de autor

Abstract

Dreptul de autor, deși este o instituţie juridică relativ tânără, în ultimele două secole are una dintre cele mai impresionante evoluţii. Din perspectiva istorică, proprietatea intelectuală a avut un parcurs dinamic complex, manifestat prin atitudini diferite faţă de creaţia umană, dar şi faţă de normele juridice care protejau ori trebuiau să protejeze fiecare categorie de drepturi, respectiv dreptul de autor. Astfel, putem spune că tot ce a fost creat de om de-a lungul existenţei şi evoluţiei sale s-a dovedit util şi necesar, conducând la progresul tehnic, tehnologic, cultural şi spiritual al întregii umanităţi. Dreptul de autor este un mijloc de promovare și păstrare a culturii naţionale a fiecărui popor. Totodată, acesta creează posibilitatea de a evalua aportul intelectual al fiecărui cetăţean la patrimoniul cultural al poporului de care aparţine și reprezintă un element esenţial al progresului. Evoluţia societăţii în plan economic, social, cultural se întemeiază pe activitatea spirituală, pe activitatea de creaţie, relaţia dintre progres și creaţie fiind una directă. Cu toate acestea recunosterea și protecţia reală a dreptului de autor asupra operelor apare foarte târziu.
