Practica judiciară privind concurenţa neloială (anii 2005-2018): studii de caz(Partea I)

Abstract

Practica judiciară nu constituie o sursă de drept în Republica Moldova, însă, implicit, instanţele de judecată au obligaţia de a aplica corect și uniform legislaţia. Judecarea cauzei de încălcare a legislaţiei concurenţiale se realizează în baza principiului accesului liber la justiţie. Astfel, la judecarea acestor cauze, în perioada de referinţă, instanţele de judecată de toate nivelurile s-au expus asupra mai multor aspecte ale dreptului. În acest context, autorii evidenţiază problemele cu care s-au confruntat acestea la judecarea cauzelor de concurenţă neloială privind folosirea ilegală a obiectelor de proprietate intelectuală prin sistematizarea și evidenţierea cazurilor în care argumentele instanţei nu sunt uniforme sau sunt contrare argumentelor ce au fost expuse de instanţă în alte cazuri similare.
