Proprietatea intelectuală și fotbalul

Abstract

Autorul oferă explicaţii pertinente pe marginea următoarelor chestiuni legate de fotbal: cine are dreptul de difuzare a meciurilor de fotbal nemijlocit pe teritoriul Republicii Moldova?; în ce temei are loc difuzarea?; localurile în care se difuzează meciurile de fotbal (pub-uri, baruri etc.) au nevoie de permisiune pentru difuzarea meciurilor?; difuzarea presupune achitarea vreunei plăţi? etc. În acest context, se subliniază că înregistrarea și difuzarea evenimentelor sportive dau naștere unor drepturi de proprietate intelectuală, inclusiv în domeniul dreptului de autor și drepturilor conexe, și anume drepturile de autor asupra operei cinematografice (film), precum și o serie de drepturi conexe în ce privește înregistrarea și difuzarea înregistrării audiovizuale a evenimentului sportiv. Protecţia evenimentelor sportive prin legi și reglementări specifice privind sportul și drepturile organizatorilor evenimentelor sportive este necesară pentru promovarea funcţiei sociale și educative a sportului.
