Protecția concurenței loiale și a secretului comercial din perspectiva apărării penale a proprietății industriale

Abstract

În articol sunt examinate situațiile privind aplicarea legii în cazurile de încălcare a drepturilor de proprietate industrială, în special a comiterii infracţiunii de concurenţă neloială, prevăzute la lit.d) art.2461„Concurența neloială” din Codul penal al Republicii Moldova. Infracţiunea de concurenţă neloială comportă anumite similitudini cu faptele prevăzute la alin.(2) art.1852 „Încălcarea dreptului asupra obiectelor de proprietate industrială” din Codul penal și la art.97 „Utilizarea ilegală a mărcii” din Codul contravenţional, unde sunt evocate, de asemenea, utilizarea mărcii care ar produce confuzie cu cea folosită legitim de un alt agent economic. Autorul constată că, în cazurile de comitere a unei concurențe neloiale, răspunderea se aplică nu conform art.2461 CP RM, dar în baza alin.(1) art.77 al Legii concurenței
