Standarde internaţionale şi europene privind protecţia proprietăţii intelectuale

Abstract

Reglementările legislaţiei naţionale, durata de protecţie a drepturilor de autor și a drepturilor conexe, în mare parte, corespunde prevederilor tratatelor și convenţiilor internaţionale și europene în domeniul proprietăţii intelectuale. Cu toate acestea, legislaţia internă trebuie să se afle într-o perpetuă modificare și actualizare, așa cum legislaţia statelor comunitare se află în continuă dezvoltare, un exemplu elocvent în acest sens fiind Directiva 2011/77/UE a Parlamentului și a Consiliului din 27 septembrie 2011 de modifi care a Directivei 2006/116/CE privind durata de protecție a dreptului de autor și a anumitor drepturi conexe, menţionată în expunerea de față. Armonizarea legislaţiei naţionale cu cea europeană va contribui substanţial la asigurarea unui nivel mai înalt de protecţie a titularilor de drepturi de proprietate intelectuală, va asigura menţinerea și dezvoltarea creativităţii în interesul autorilor, pieţei interne, industriilor culturale, consumatorilor de produse ale creaţiei intelectuale, precum și în avantajul societăţii în ansamblu.
