Het verschoningsrecht en de accountant in historisch en toekomstig perspectief

Abstract

In dit artikel wordt een overzicht gegeven van artikelen uit het MAB, waarin aandacht is besteed aan de geheimhoudingsplicht en het (afgeleid) verschoningsrecht in relatie tot het beroep van accountant. In dat verband is met name gekeken naar de externe of openbare accountant. De besproken artikelen zijn verschenen tussen 1948 en 2010. Verder is er aandacht voor de bewogen praktijk van het forensisch onderzoek, waarin zowel de accountant als de advocaat actief zijn. Ook in deze praktijk is het debat over de reikwijdte van het verschoningsrecht levendig. Tot slot wordt aandacht besteed aan de modernisering van het Wetboek van Strafvordering. In dat kader is na zes jaar van voorbereiding een wetsvoorstel met een memorie van toelichting in april 2021 aan de Raad van State voorgelegd. De verwachting is dat het gemoderniseerde Wetboek van Strafvordering in 2026 zal worden ingevoerd.
