Abstract

Hoe geeft een accountantsorganisatie adequaat invulling aan de zorgplicht o.g.v. artikel 14 Wta? Op basis van de wetsgeschiedenis, de publieke uitingen van de toezichthouder en de rechtspraak geven de auteurs een overzicht van de invulling van de zorgplicht in de praktijk. Het bronnenonderzoek leidt tot de conclusie dat zorgplicht een veelomvattend begrip is, dat de beschrijvingen van overtreden van de zorgplicht en naleven van de zorgplicht niet elkaars spiegelbeeld vormen, dat zorgplicht zowel inspanning als resultaat omvat en dat de invulling van de zorgplicht overlap vertoont met andere wettelijke vereisten. Auteurs betogen dat een wetswijziging wellicht de oplossing biedt.
