Znaki towarowe i prawa ochronne na znaki towarowe

Abstract

W artykule została przedstawiona problematyka dotycząca znaku towarowego, który odróżnia towary i usługi tego samego rodzaju pochodzące od różnych przedsiębiorców. Współcześnie prawa do posiadania znaków towarowych odgrywają ogromną rolę, stając się podstawą do budowania wizerunku i reputacji firmy. Faktycznie jest to bardzo cenny składnik majątku przedsiębiorstwa. Jednocześnie jego rejestracja to istotny element promocji przedsiębiorstwa, niektórych towarów tego przedsiębiorstwa lub świadczonych usług. Po stosunkowo długim okresie stabilizacji prawa regulującego problematykę ochrony znaków towarowych w ostatnim okresie zostały dokonane zmiany, które mają ułatwić przedsiębiorcom sposób uzyskania praw wyłącznych, tym samym dostosowano przepisy do wymogów Unii Europejskiej.
