Regulacja rynku narkotyków w Polsce w latach 1997-2005 a równowaga systemu instytucjonalnego

Abstract

Celem artykułu jest opis i próba wyjaśnienia przebiegu zmian prawnych w zakresie przekształceń ustawy o przeciwdziałaniu narkomanii (UPN) w Polsce w latach 1997-2005 z perspektywy nowej ekonomii instytucjonalnej. Szczególnym obszarem zainteresowania pozostaje jednak karanie za posiadanie narkotyków. Dodatkowym zamierzeniem jest próba odpowiedzi na pytanie, czy zmiany UPN w zakresie karania za posiadanie niewielkich ilości substancji odurzających nie doprowadziły do zakłóceń w obrębie systemu instytucjonalnego, czyli w sieci wzajemnych powiązań między strumieniami działań w gospodarce. W artykule zawarto próbę zidentyfikowania narzędzi pozwalających analizować dynamiczny proces przekształceń instytucjonalnych, do których należą m.in. normatywna i ekonomiczne teorie regulacji oraz ścieżka rozwoju. Ich wykorzystanie uprawdopodabnia właściwą identyfikację przyczyn zmian prawnych dotyczących ustawy o przeciwdziałaniu narkomanii. (abstrakt oryginalny)
