Intellectual Property System in China

Abstract

The article explores modern IP system of the People’s Republic of China, including the regulation of patents (inventions, industrial designs, utility models), plant varieties, trademarks,geographical indications, genetic resources and trade secrets. Particular attention is paid to the weak points of Chinese IP system, which causes fears from international companies planning or already entering the PRC market, connected with the risk of violation of their intellectual property rights. It is concluded that the PRC is actively working to create favorable conditions for attracting innovative international companies that have a competitive advantage in the production of high-tech products. Nevertheless, despite the steps taken, a number of problematic issues impeding the full transformation of the PRC into a country capable of ensuring a high level of protection of IP rights are still unresolved.
