Skenario Putusan WTO RED II Dan Respon Pemerintah Indonesia

Abstract

Pada tahun 2018, Uni Eropa telah menerbitkan kebijakan RED II yang membatasi penggunaan biofuel berbasis kelapa sawit karena beresiko memiliki Indirect Land Use Change (ILUC) yang tinggi serta dapat meningkatkan emisi gas rumah kaca. Pembatasan penggunaan CPO ini dapat menurunkan nilai ekspor minyak sawit Indonesia ke Uni Eropa. Hal ini dapat bertentangan dengan disiplin WTO karena dapat mempengaruhi perdagangan internasional. Berdasarkan hal di atas, Pemerintah Indonesia telah melayangkan permintaan konsultasi dalam proses Dispute Settlement di World Trade Organization (WTO) pada tahun 2019 sebagai respons kebijakan RED II. Saat ini, Indonesia tengah menunggu diterbitkannya Panel Report yang diperkirakan putusan tersebut akan dikeluarkan pada akhir tahun 2022 atau awal tahun 2023. Terdapat beberapa alternatif penyelesaian sengketa di WTO, antara lain: (1) Banding, (2) Tidak banding, atau (3) Mutually Agreed Solutions. Jika putusan DSB WTO mengabulkan gugatan Indonesia, maka akan hal ini dapat menjadi insentif pada produksi biodiesel karena pangsa Uni Eropa yang besar. Jika putusan DSB WTO menolak gugatan Indonesia, maka Indonesia perlu naik banding dan menguatkan diplomasi ekonomi.
