Requirements of the Rule of Law from the Perspective of European Union Law - Primary and Derived European Law

The Treaty of Lisbon maintains the principle of the supremacy of Community law in relation to national law, and in this respect we consider it necessary to present briefly some elements of European law. The European legal order, or in other words, European law, consists of a series of structured and hierarchical rules. European law consists of the three founding treaties of the Union and the amending treaties, which have adapted to the new realities of European life and which, moreover, emphasize the dynamic and unpredictable nature of European integration. The Treaties represent the fundamental part of European law and the legal system of the European Union because, on the basis of and in accordance with them, all the rules that make up all secondary legislation are generated, as well as the other acts of the European Union. Moreover, primary legislation is the essence of the Union's constitutional framework and, together with the principles of law, occupies the most important position in the hierarchy of sources of Community law.
