La lutte contre la fraude et l’évasion fiscales : nouvelles mesures prises au niveau national, européen et international. Vers un FATCA européen?

Abstract

La fraude fiscale a été présente à toutes les époques, dans tous les pays du monde, à des degrés divers. Le fléau de la fraude et l'évasion est d'une importance particulière car elle nous touche tous, ayant une dimension transfrontalière. L’infraction se produit à l'intérieur d'un pays et travers plusieurs pays, à la fois au sein de l'UE et à l'échelle mondiale. La plupart des auteurs de la littérature juridique ont établi une distinction entre l'évasion fiscale et la fraude fiscale, mais il y a certains auteurs qui assimilent, en partie, les deux notions. Lutte contre la fraude et l'évasion fiscale exige une action non seulement au niveau national qu'au niveau de l'UE et mais aussi international. Dans la lutte contre l'évasion et la fraude fiscale, la coopération entre les administrations fiscales joue un rôle essentiel, et l'échange de renseignements est fondamental dans cette coopération. Notre recherche a pris en compte plusieurs aspects, mais nous avons arrêté l'attention en particulier sur les nouveaux moyens de lutte contre le grand mal qui est la fraude fiscale au niveau national, européen et international. Aussi, dans la deuxième partie, nous présenterons quelques aspects relatives à la loi FATCA (Foreign Account Tax Compliance Act), l'arme anti-évasion fiscale américaine. Est-elle maintenant un modèle pour l'Europe? On dirige vers un FATCA européen?
